One new area is strategic law suits against public participation (SLAPP), SLAPP suits are becoming increasingly common. The point of these law suits is to intimidate and silence critics by burdening them with the cost of a legal defence until they abandon their criticism or opposition. With SLAPP law suits, the plaintiffs are usually a large entity with deep pockets whose goal is to force “ordinary Joes” to “shut up” by having them buckle under to fear, intimidation, huge legal costs and exhaustion. As one learned Judge said, “short of a gun to the head, a greater threat to the Constitution can scarcely be imagined”.
